ISSUES OF FAMILY LAW
Every family has some or the other issues which all the family members have to face and go through. These are several such matters which come under the jurisdiction of law and can be solved in a legal manner.Family Law is different in some cases as per the central government of varied countries. These matters of family law are discussed below:
One such family law problem is the issue of Marriage. Many a times, it is been seen that people perform fraudulent activities in marriages. Marriage is a ceremony after which there is a relationship developed between spouses, their children and their in-laws. Marriages like child marriage or marriages done forcefully or something illegal imposed on the spouse by way of marriage come under the family law rules and regulations. Most of the cases are about dowry and fraud done with either of the families of groom or bride. Such activities call for strict actions under the law and severe punishments.
One such kind of concern is the civil unions which is also a kind of marriage that mostly involves two people of the same sex or gender. Though in some countries, these kinds of marriages are considered to be illegal but, there is a continuous change in rules in most of the countries for such concerns.
There are different code of conduct to be followed pertaining to family law of Adoption in any country. It gives legality to the phase of adopting a child by non biological parents who promise to take care of the child even they have not given birth to him or her. This is done in a legal format which gives all the rights to the child similar to what a real child must have from his/ her biological parents.
Family law also deals with the matters of Surrogacy done in a traditional or gestational manner. There are many cases, in which people are incapable to give birth to a child due to health issues and in this case, surrogacy might come in picture. This is also done on a legal basis, which is done by giving an amount as compensation for the care and medical facilities of the mother.
Children are very sensitive to new things going around them. Child abuse is one such sensitive issue which takes place due to any illegal activity that might have happened with a child or a minor. These activities can be physical abuse, neglecting, emotional abuse, psychological abuse or sexual abuse. All such matters are under the jurisdiction of family law. Such activity might take place at schools, or colleges, or at home.
Another issue under family law is Divorce and alimony. When both of the spouses, by their will, decide to end their marriage, it is called as divorce. This requires to follow a legal procedure of taking divorce and get free from all the duties and responsibilities and also, to have a legal right to remarriage. In some cases, either of the spouses may demand for alimony as a compensation to agree to the conditions of a divorce agreement. This sometimes also leads to the issues of child custody, to decide, as to which of the parent will be responsible to take good care of their child.
